I am wanting to get a 49cc moped because im allowed to drive one in state of kansas legally with a instructors permit. I am wondering what the max speed for mopeds are becuase on ebay some say 30mph and some say 45 mph. Is there a maximum speed to be considered as a 49cc moped in kansas?

KANSAS syas that you can ride with a DRIVERS license only, or a limited MOPED only license.
A Moped in Kansas is no more than 30mph and no more than 50cc`s.
if its a 50 but goes 45mph, then you need a Motorcycle endorsement!
Same with scooters too. Mopeds have skinny large wheels and pedals.
they allow "motorized" bicycles up to 135cc`s, But thats only to allow Whizzers and Whizzer replicas,which have a flathead type 4 stroke motor which have larger displacements but put out little horsepower, like a Briggs and Stratton.
